3. Information about us and how to contact us

3.1 Who we are. We are ISCA Limited a company registered in England and Wales. Our company registration number is 01605416 and our registered office is at C/o George Hay & Company, 83 Cambridge Street, Pimlico, London SW1V 4PS.

3.2 How we will communicate. The School is the usual point of contact for matters relating to the Booking. Please send booking changes, cancellations and routine questions through the School, which will pass them to us. Where necessary, ISCA may contact you directly about an urgent matter concerning the Student’s welfare or safety. You may also contact ISCA directly about a safeguarding concern or to exercise your data protection rights.

3.3 “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.

4. Booking Confirmation and the Contract

4.1 The Booking Confirmation. Once the School has confirmed with you and with us the Student’s eligibility to attend the Trip, we will supply the School with the Booking Confirmation who will forward it on to you. The Booking Confirmation is an offer made by us to you to enter into the Contract subject to these Terms. Please note the group organiser (typically the school) has independent control over which students are permitted to register for the programme. Their decision is final.

4.2 Formation of the Contract. The Booking Confirmation will be deemed accepted by you, and therefore the Contract will come into force immediately once all of the following have occurred to our satisfaction:

(a) you have confirmed your acceptance of the Terms by clicking the “ACCEPT” button at the end of the Terms & Conditions Summary;

(b) you have provided the requested details for the Student; and

(c) we have received the Deposit which is non-refundable.

4.3 Delays in confirming acceptance. If you fail to fulfil any of the three requirements under clause 4.2 on or before the deadline specified in the Booking Confirmation, the Booking Confirmation will be deemed to have expired and you will need to contact the School to discuss the possibility of a further Booking Confirmation being issued. Issuing a further Booking Confirmation shall be at our absolute discretion.

5. The Student Code of Conduct & Mobile Phone Policy

The Student must abide with both our Student Code of Conduct and our Mobile Phone Policy throughout the Trip. If the Student seriously breaches the Student Code of Conduct or Mobile Phone Policy, or their behaviour poses a significant risk to themselves or others, ISCA may take proportionate action, including ending the Student’s participation in the Trip. ISCA will consider the circumstances, consult the School where practicable, and continue to meet its safeguarding and welfare responsibilities. Where the Student must return home, ISCA will work with the School and parent or guardian to arrange a safe journey. The parent or guardian will be responsible for reasonable additional costs arising from the Student’s conduct, except to the extent that ISCA is responsible for those costs.

6. Passports, Visas (where required) and permission to enter the UK

You are responsible for ensuring that the Student has a valid passport and the permission required to travel to and enter the UK. If the Student requires a visa, you must obtain the appropriate Standard Visitor visa before travel. If the Student does not require a visa but needs an Electronic Travel Authorisation (ETA), you must obtain the ETA before travel. Requirements depend on the Student’s nationality and circumstances, so please check them and apply in good time. ISCA can provide a letter confirming the Booking if needed but cannot guarantee that an application will be approved. If the Student cannot travel because the required documents or permission have not been obtained, please notify the School promptly; the cancellation terms in clause 12 will apply.

7. Photography

We may use genuine photographs and film of participating students and adults from ISCA programmes in our brochures and other marketing materials, subject to our Privacy Policy and safeguarding procedures. If you do not want images of the Student used for this purpose, please inform the School in writing before the Trip. You may also ask the School to pass on a later request to stop future use and remove images from ISCA-controlled marketing materials where practicable.

Permission for photography, filming or publicity does not authorise ISCA to use an identifiable Student’s image, video, likeness or voice as source material for generative AI. ISCA does not permit that use under its Responsible Use of Artificial Intelligence Policy.

8. Your rights to make changes to the Booking

If you wish to make a change to the Booking please contact the School immediately. We will let the School know if the change is possible. If it is possible the School will let you know about any changes to the Price or anything else which would be necessary as a result of your requested change and ask you to confirm to the School whether you wish to go ahead with the change. If we cannot make the change or the consequences of making the change are unacceptable to you, you may want to end the Contract (see clause 11 Your rights to end the Contract).

9. Our rights to make changes to the Booking

9.1 Changes that do not alter the nature of the programme. We reserve the right to make changes to the Booking:

(a) to reflect changes in relevant laws and regulatory requirements;

(b) to implement minor technical adjustments and improvements, for example to address a security threat, poor weather or some other reason beyond our control; and

(c) to address airline scheduling changes including amending the travel itinerary.

In such instances and where possible we may provide alternatives of a reasonably equal or better standard without notice to you and without alteration of the Price.

9.2 Very significant changes to the Booking.

A very significant change is one that fundamentally alters the nature of the programme described in the Booking Confirmation. Examples include replacing the UK residential programme with a substantially different programme, changing its principal location, or substantially shortening its duration.

If we propose a very significant change before the residential programme begins, we will inform the School as soon as reasonably practicable and explain the proposed change. You may either accept the revised Booking or end the Contract by notifying the School within the reasonable period stated in our notice. If you end the Contract for this reason, we will refund all sums paid to ISCA for the Booking, including the Deposit.

10. Providing the Trip

10.1 When we will provide the Trip. The Trip to which the Booking relates will take place on the dates specified in the Booking Confirmation.

10.2 What will happen if you do not give required information to us. We need certain information from you so that we can arrange the Trip, in particular the information detailed in the Booking Confirmation. If you do not provide this information, or if you give us incomplete or incorrect information, we may either end the Contract (and clause 13.1(b) will apply) or make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result. We will not be responsible for not supplying any part of the Booking if this is caused by you not giving us the information we need within a reasonable time of us asking for it.

11. Your rights to end the Contract

11.1 You can always end your Contract with us:

(a) If you want to end the Contract because of something we have done or have told you we are going to do, see clause 11.2; or

(b) In all other cases, see clause 11.3.

11.2 Ending the Contract because of a change or error by us. You may end the Contract before the residential programme begins if:

(a) we propose a very significant change to the Booking under clause 9.2 and you notify the School within the period stated in our notice that you do not accept it; or

(b) we tell you that the Price or a material part of the programme was stated incorrectly in the Booking Confirmation and you do not wish to proceed on the corrected terms.

If you end the Contract for either of these reasons, we will refund all sums paid to ISCA for the Booking, including the Deposit. A recalculation of the contribution towards accompanying School staff flights under clause 15.6 is not, by itself, a pricing error under paragraph (b). Nothing in this clause affects any other right you may have to end the Contract or obtain a remedy where ISCA fails to meet its legal obligations.

11.3 Ending the Contract where we are not at fault. You may cancel the Booking before the Trip begins by giving written notice to the School. The date the School receives your notice is the cancellation date. Any refund will be calculated under clause 12.3. The same cancellation terms apply whether ISCA arranged the Student’s flights or the family arranged them independently.

12. How to end the Contract with us

12.1 How to cancel. To cancel the Booking, you must notify the School in writing. The School will pass your notice to ISCA. The cancellation date is the date the School receives your written notice.

12.2 How we will refund you. Where a refund is due, we will return it using the method by which you paid, where practicable. A refund cannot exceed the amount you have paid to ISCA.

12.3 Cancellation charges and refunds. If you cancel under clause 11.3, the following cancellation charge applies to the total Price shown in your Booking Confirmation, as adjusted under clause 15.6 where applicable:

Cancellation date Cancellation charge Refund if the Price has been paid in full
On or before 31 March 2027 30% of the Price (the Deposit) 70% of the Price
1–30 April 2027 50% of the Price 50% of the Price
1–31 May 2027 75% of the Price 25% of the Price
On or after 1 June 2027 100% of the Price No refund

Any refund is the amount you have paid to ISCA less the applicable cancellation charge, but will not be less than zero. This schedule applies whether ISCA arranged the Student’s flights or the family arranged them independently. It does not apply where clause 9.2 or 11.2 entitles you to a full refund.

12.4 When your refund will be made. We will make any refund due to you within 14 days of the cancellation date.

13. Our rights to end the Contract

13.1 We may end the Contract if you break it. We may end the Contract at any time by writing to you if:

(a) you do not make any payment to us when it is due and you still do not make payment within 5 days of us reminding you that payment is due; or

(b) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the Booking, in particular the information requested in the Booking Confirmation.

13.2 We may end the Contract prior to the Trip due to the Student’s actions. If the Student is permanently excluded from their School before the Trip, ISCA may review whether the Student can still participate. We will consult the School and consider the circumstances before deciding whether to end the Booking. If the Student’s behaviour during the Trip raises serious concerns, ISCA may take action under clause 5, including ending the Student’s participation where appropriate.

13.3 Refund if we end the Contract under clause 13.1 or 13.2. If we end the Contract under clause 13.1 or 13.2, we will calculate any refund using the cancellation charge in the table in clause 12.3, based on the date we notify the School that the Contract is ending. Any refund will be the amount paid to ISCA less that cancellation charge, but will not be less than zero. If only the Deposit has been paid, no refund will be due.

13.4 Events outside our control. If an event outside ISCA’s reasonable control prevents Students from travelling to the UK or prevents us from safely providing the residential part of the programme, we will inform the School as soon as reasonably practicable. Where possible, we may offer a suitable postponed residential programme or a credit towards a future ISCA programme. You are free to decline either option.

If the residential programme cannot be provided and you decline the alternative offered, we will assess the refund due for the part of the programme that cannot be provided. This does not automatically entitle you to a refund of payments relating to online teaching or other services already provided. We will explain our calculation and honour any refund rights you have under applicable law. You will not be required to accept a credit instead of a refund to which you are legally entitled.

14. If there is a problem with the Booking or the Trip

14.1 How to tell us about problems. If you have any questions or complaints about the Booking or the Trip, please contact the School.

14.2 Summary of your legal rights. We are under a legal duty to supply the Booking and the Trip in conformity with this Contract. Nothing in these Terms will affect your legal rights.

15. Deposit, Price and payment

15.1 The non-refundable Deposit. The Deposit is 30% of the Price and is payable when the Booking is confirmed. ISCA begins delivering the programme before the residential stay, including online teaching and preparation from November to June, and makes advance commitments for the Student’s place. If you choose to cancel after the Booking has been confirmed, the Deposit is non-refundable, subject to clause 12 and any rights you have under applicable law.

15.2 Where to find the Price for the Booking. The Price will be the Price indicated on the Booking Confirmation. We take all reasonable care to ensure that the Price advised to you is correct. However please see clause 15.3 for what happens if we discover an error in the Price.

15.3 What happens if we got the Price wrong. It is always possible that, despite our best efforts, the Price stated on the Booking Confirmation may be incorrect. We will normally check the Price before submitting the Booking Confirmation. However, if we accept and process your Booking Confirmation where a Price error has occurred, we may end the Contract and refund to you all sums you have already paid.

15.4 When and how you must pay. We accept payment with credit card, debit card or American Express. You must pay the non-refundable Deposit on accepting the Booking Confirmation. The balance of the Price will be payable by 31 March 2027.

15.5 We may charge interest if you pay late. If you do not make any payment to us by the due date we may charge interest to you on the overdue amount at the rate of 4% a year above the base lending rate of the Bank of England from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount. You must pay us interest together with any overdue amount.

15.6 Contribution towards accompanying staff flights. Where ISCA arranges flights for a School group, the Price in the Booking Confirmation includes the Student’s own airfare and a provisional contribution towards the flights of the School staff accompanying that group. The Student’s own quoted airfare will not change under this clause.

The provisional contribution is calculated by dividing the cost of the accompanying School staff’s flights equally among the anticipated number of paying Students in that School group. Once the final number of paying Students and accompanying School staff is confirmed following the deposit deadline, we will recalculate the contribution by dividing the cost of those staff flights equally among the final number of paying Students. The Student’s Price will increase or decrease by the difference between the provisional and final contribution.

We will provide the School with the final calculation and notify you of any change before the balance of the Price is due. This clause applies only to the contribution towards accompanying School staff flights.

16. Liability for loss or damage

16.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this Contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the Contract was made, both we and you knew it might happen, for example, if you discussed it with the School and this was explained to us during the sales process. Our total liability to you under this clause 16.1 shall be limited to the Price.

16.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, subcontractors or suppliers, or for fraud or fraudulent misrepresentation.

16.3 You shall indemnify us. You shall indemnify us and keep us indemnified from and against any and all direct and indirect loss, damage, costs, claims, demands or liability arising out of any injury or other loss to us or our employees, agents or our contracted third parties resulting from your or the Student’s negligence or breach of the Contract or the Student Code of Conduct unless we are liable for the same under these Terms.

17. Travel insurance

We strongly recommend that you arrange suitable travel insurance for the Student as soon as the Booking is confirmed. You should check that it covers cancellation, medical expenses, travel disruption, repatriation and personal possessions for the full period of travel. You are responsible for checking the policy’s terms, exclusions and level of cover.

18. Personal possessions

The Student is responsible for looking after their personal possessions throughout the Trip, including during free time and managed independent activities. ISCA is not responsible if the Student loses, misplaces or leaves an item behind, or if an item is stolen or damaged without fault on ISCA’s part. You should ensure the Student has suitable insurance for valuable belongings. Nothing in this clause limits ISCA’s responsibility where loss or damage is caused by our negligence or where liability cannot lawfully be excluded.

19. Use of your personal information

How we may use your personal information. We collect and use personal information about you and the Student to arrange and deliver the programme and for the other purposes explained in our Privacy Policy. The Privacy Policy explains how that information is used, shared and protected.

20. Other important terms

20.1 Our obligations or rights under the Contract may be performed by us or through our employees, agents, subcontractors or affiliates.

20.2 Nobody else has any rights under this Contract. This Contract is between you and us. No other person shall have any rights to enforce any of its terms.

20.3 If any provision or part-provision of these Terms is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but shall not affect the validity and enforceability of the rest of these Terms.

20.4 Even if we delay in enforcing this Contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking this Contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the Booking, we can still require you to make the payment at a later date.

20.5 Which laws apply to this Contract and where you may bring legal proceedings. These Terms are governed by English law and you can bring legal proceedings in respect of the Booking in the English courts.
